Terms of Service
Effective date: August 31, 2026
These terms govern your use of DMpilot ("we", "us"), a service that automates Instagram replies and runs comment-based giveaways. By using the service you agree to these terms.
1. The Service
For the Instagram professional account you connect, we provide the following features.
- Automated DM delivery triggered by comments, DMs, and story mentions
- Comment-based giveaways and winner selection
- Reporting and statistics on automation activity
2. Eligibility and Account Connection
An Instagram professional (business or creator) account is required. You may only connect accounts you are authorized to manage.
You can disconnect an account at any time from the settings page. On disconnection, the stored access token and related data are deleted immediately.
3. Compliance with Meta Platform Policies
The service operates through Meta’s Instagram API and complies with Meta’s Platform Terms and Developer Policies. Messages are sent only within the 24-hour messaging window and the private-reply-to-comment policy; we never send unsolicited cold DMs.
You may not use the service for spam, misleading content, infringement of third-party rights, or any other purpose that violates Meta policies or applicable law.
4. Responsibility for Giveaways
You are solely responsible for the rules, prizes, winner notification, and legal compliance of any giveaway you run with the service. We provide the tooling and are not the promoter of your giveaway.
5. Fees and Subscriptions
The service is offered on a free plan with usage limits and on paid subscription plans. Billing period, price, and cancellation terms are those shown at the time of purchase.
You may cancel a subscription at any time and retain access until the end of the current billing period.
6. Changes and Interruptions
We may change or suspend all or part of the service for maintenance, Meta API policy changes, or other unavoidable reasons. We announce material changes in advance.
7. Limitation of Liability
We are not liable for damages caused by matters outside our control, including Meta API outages or Instagram account restrictions resulting from your own policy violations.
Except in cases of our willful misconduct or gross negligence, our aggregate liability is limited to the fees you paid in the preceding three months.
